Terms of Service
> DRAFT — pending counsel review. Do not rely on this document. The final version will be substantially different.
1. Introduction
JTX Markets (the "Platform", "we" or "us"), operated by JTX Markets [Entity name pending confirmation], offers proprietary trading challenge accounts and funded live-capital accounts to qualified traders (the "Services").
By registering for an account, purchasing a challenge, or otherwise using the Services, you ("the User", "you") agree to be bound by these Terms of Service and the Policies incorporated below.
2. Scope of Services
JTX Markets offers:
Trading takes place on the JTX matching engine covering crypto, forex, equity, commodity and index perpetual contracts.
3. Not Client Money
Funds paid for challenge accounts are challenge fees, not client deposits. JTX Markets is not a broker, exchange, or investment firm. Trading on funded accounts is conducted using JTX capital under a profit-share arrangement, not the trader's own funds.
4. Account Registration + KYC
The User must provide identifying information satisfactory to JTX and its KYC vendor before purchasing a challenge or receiving any payout. Standard KYC includes identity document, address verification and selfie liveness check.
5. Prohibited Jurisdictions
The Services are not available to residents of the United States of America, sanctioned jurisdictions (as maintained by OFAC, the EU, UN and other applicable authorities), or any jurisdiction where the offering of prop-firm challenge products is prohibited. [Counsel to finalise the specific list.]
6. Payouts
Trader profit share is paid in USDT on the trader's requested destination chain (ETH, Arbitrum, Tron, Solana). Payout requests are subject to KYC, 2FA, sanctions screening and ops review as described in the Payouts documentation.
7. Rule Enforcement
Account rules (profit target, daily loss, drawdown, prohibited practices) are enforced automatically by the matching engine. Breaches close the affected account with full audit trail. Disputes are handled through the support process; JTX's determination is final subject to arbitration under Clause 15.
8. Prohibited Practices
The User may not: hedge across multiple JTX accounts; copy trades between accounts; use third-party managed-trading services; engage in market manipulation (spoofing, wash trading, layering); engage in latency arbitrage of scheduled economic data releases; or use the Services in violation of any Applicable Laws. Violation forfeits the affected accounts and any accrued but unpaid profit share.
9. Fees
Challenge account fees are paid at purchase. Upgrade fees (for the 90/10 split) are optional. Chain gas fees on payouts are absorbed by JTX. All fees are non-refundable except as set out in the Refund Policy.
10. No Trading Advice
JTX Markets does not provide investment, trading, financial, tax or legal advice. Educational content on the Platform is for information only.
11. Termination
Either party may terminate this agreement at any time. On termination, the trader's accounts are closed; funded-account balances are settled per the profit-split rules; any pending payouts are processed subject to standard checks.
12. Limitation of Liability
To the fullest extent permitted by law, JTX Markets is not liable for indirect, consequential, incidental or special damages, or for lost profits, business, revenue, reputation or goodwill. [Counsel to draft the specific limitation appropriate to the jurisdiction.]
13. Indemnity
The User indemnifies JTX Markets against any claims arising from the User's breach of these Terms, violation of Applicable Laws, or misuse of the Services.
14. Governing Law
These Terms are governed by the laws of [jurisdiction — counsel to specify based on operating entity].
15. Dispute Resolution
Disputes are resolved by arbitration under the rules of [tribunal — counsel to specify], seated in [seat], in English, before one arbitrator.
16. Variations
JTX Markets may vary these Terms from time to time by publishing an updated version. Continued use of the Services constitutes acceptance of the varied Terms.
